No more adult swim time in Fall Creek because it discriminates

I first heard about this story today while sitting around the pool, with family and friends. I thought to myself, this must be a joke.  To my surprise, when I looked it up, It was true.

In a report by Natasha Barrett at ABC 13 Houston she says that Fall Creek in Humble has changed their rules.

No more adult swim. Instead, everyone is out of the pool for what’s now called a safety break.

The Fall creek rules have changed because of a federal case in California that ruled adults only swim time discriminates against other association members who have children by treating them differently from those without children. That kind of differential treatment is also barred by the federal Fair Housing Act.

An attorney for Fall Creek’s homeowners association says it decided to end adult swim when it was rewriting its swimming pool contract to avoid any future issues.
